AN ORDINANCE to amend and reordain Section 150-391, Taxable Transactions, of the Code of the City of New Orleans, relative to increasing the number of pages from ten to twenty-five permitted under the tax fee of $300.00 regarding certain transactions; and otherwise to provide with respect thereto.

SECTION 1. THE COUNCIL OF THE CITY OF NEW ORLEANS HEREBY ORDAINS, That Section 150-391 of the City Code of New Orleans is hereby amended and reordained to read as follows:

Section 150-391. Taxable transactions.

(1) c. If a sale or mortgage of a single-family residence or residential double exceeds twenty-five pages, a notarized statement stating that the property is a single-family residence or residential double shall be required.

(2) For all other transactions, the sum of $300.00 for each instrument, act, writing or document up to a maximum of twenty-five pages, plus an additional tax of $100.00 for each additional page, provided that the total amount of tax for each instrument, act, writing or document shall not exceed the sum of $2,500.00.

SECTION 2. For any transaction having taken place on or following October 1, 2001, any person who has paid an amount in excess of $300.00 for a transaction described  in 150-391 (1) or Section 150-391 (2) of the City Code that was twenty-five pages or less, shall be entitled to a refund from the City of the difference between the amount paid and $300.00.  For any transaction having taken place on or following October 1, 2001, any person who has paid an amount in excess of $300.00 for a transaction described in Section 150-391 (1) or Section 150-391 (2) that was in excess of twenty-five pages, shall be entitled to a refund from the City not to exceed $1,500.00.  Any person claiming such refund shall submit a claim for a refund to the Department of Finance no later than May 31, 2002. The claim for refund shall be submitted by the claimant to the Department of Finance on a form provided by the Department of Finance.
